Registrant refers to the Registrant of MEDISCA products and/or services and is a licensed pharmacist or other appropriately state licensed professional and has been given the right to access username and password protected screens of this Website. The Registrant in many instances, but not always, is the Subscriber.
Subscriber refers to the individual or business entity that has purchased a product and/or service from MEDISCA, but does not necessarily have the right to access user name and password protected screens of this Website or has not been deemed a Subscriber.
Agreement refers to the totality of these Terms and Conditions which constitute a legal document.
Content refers to the content of this Website, which includes, but is not limited to, products, services, text, information, images, graphics, features, e-mail, third party notifications, registration, executable functions and applications, policies, disclosures, and disclaimers.
Terms and Conditions refers to the terms and conditions of this Website Agreement.
Visitor refers to the general public.
At MEDISCA, we value the trust that our customers, business partners, and employees place in us to appropriately use and protect information shared with us. Scope: This Privacy Statement applies to all MEDISCA affiliates and subsidiaries. MEDISCA business partners and other third parties, have their own websites and privacy policies. We encourage you to read the privacy policies of third parties to understand their policies and your options.
MEDISCA processes your personal identifiable information for legitimate and legal interests in order to conduct its everyday business activities, provide its services to you, as well as abide by federal and state laws or any legal proceedings.
Information Collection: MEDISCA does not collect personally identifiable information from the Visitor, Subscriber and/or Registrant unless they provide it to us knowingly. Personal identifiable information includes first and last name, email address, telephone number, address, company name, occupational role, fax number, date of birth and purchase and ordering history. We only gather information from our Visitors, Subscribers and/or Registrants when it is voluntarily submitted to us by you. If you have registered to use special purpose features on our website, we may use the information you supplied for the purpose of providing the services you have requested, this may include financial information provided. You can always follow-up or change your personal information by emailing or calling us. MEDISCA may contact you via email to notify you of any changes to MEDISCA services, or special offers that may be of interest to you. We will retain your information for as long as your account is active or as required to provide you with our services. We may retain and use your information as necessary to comply with our legal obligations, resolve disputes, and/or enforce our agreements. MEDISCA will take reasonable precautions to protect the personal information collected from the Visitor, Subscriber and/or Registrant from loss, misuse and unauthorized access, disclosure, alteration or destruction. MEDISCA does not store your credit card information nor will it share it with other third parties.
MEDISCA wishes to serve the Visitor, Subscriber and/or Registrant as best as possible. As such, MEDISCA conducts an optional on-line survey for which the information collected is used for internal purposes only.
Cookies: MEDISCA employs the use of cookies for the purpose of record-keeping and improved online navigation purposes; transferring information on the computer of a Visitor, Subscriber and/or Registrant to this website. The information transferred is non-identifiable and only used to make navigation and the use of the website more convenient for the Visitor, Subscriber and/or Registrant. Telephone: In addition to the above, MEDISCA reserves the right to monitor and/or record your telephone conversations with our representatives for our mutual protection, to enhance our customer services and to confirm any decisions made with you.
Video Surveillance: When you visit one of the MEDISCA facilities, you may be video recorded for the safety of yourself and MEDISCA employees. MEDISCA will use such images and information for security, fraud and loss prevention as well as incident reporting purposes. If required by law, MEDISCA may submit video surveillance records to law enforcement officials.
Information Usage: MEDISCA uses personal identifiable information provided by you for various purposes. This includes to operate, maintain and improve our services, establish an online MEDISCA account at your request, to process purchase orders (including orders made online) and keep you informed about the status of your order and/or service. MEDISCA also uses your information to provide customer service, identify your preferences so we can notify you of new or additional services and promotions that might be of interest to you, and validate your ability to access and/or use certain services that may only be intended for individuals meeting certain eligibility requirements or criteria such as health care professionals.
Information Storage: MEDISCA will use the appropriate measures and safeguards to protect your personal information within MEDISCA’s Systems. MEDISCA will retain such information for the time it is required and for purposes explained within this Privacy Statement. Such information may only be stored directly in or outside of Canada without depreciating the protection of your personal information. However, your personal information may be subject to the laws and jurisdictions of where it is stored.
Sharing Your Information: MEDISCA will not share, sell, rent or trade your personal information other than as disclosed within this Privacy Statement. We reserve the right to disclose your personal information as required by law and when we believe that disclosure is necessary to protect our rights and/or comply with a judicial proceeding, court order, or legal process served on us.
MEDISCA may retain other companies and individuals to perform specified services on our behalf and we may collaborate with other companies and individuals in order to provide particular products or services to you (collectively, “Providers”). Examples of Providers include delivery companies, customer services and support providers, email and SMS vendors, and credit card processing companies. MEDISCA Network currently uses a third party provider to process credit card transactions on our behalf. Information collected by third parties includes your name, address, and email as well as your financial information, such as credit card number and expiration date. Such use by third parties is subject to their own privacy policies and we encourage you to review such third party policies to understand how your information is processed and stored.
Security Policies: MEDISCA cannot 100% guarantee the safeguard of your personal and other information from theft, loss, or unauthorized access or use and cannot be held accountable for such incidence. Notwithstanding the above, MEDISCA makes no representation as to the reasonableness, efficacy, or appropriateness of the measures we use to safeguard such information. When making an account on MEDISCA’s website, you are responsible to maintain the secrecy of your own passwords. If you have reason to believe that the security of your account has been compromised, please notify MEDISCA immediately.
International Transfers: MEDISCA’s principle office is located in Canada and, as such, personal information will be collected and stored at our principle location in Montreal. In accordance with applicable law, we implement measures to ensure that any transferred data remains protected and secure.
Online Advertising: We use Google AdWords Remarketing to help advertise MEDISCA services across the internet. AdWords Remarketing will display relevant ads tailored to you based on content you have already viewed on the MEDISCA website by placing a cookie on your machine. THIS COOKIE DOES NOT IN ANYWAY IDENTIFY YOU OR GIVE ACCESS TO YOUR COMPUTER. The cookie is used to say “This person visited this page, so show them ads relating to that page.” Google AdWords Remarketing allows us to tailor our marketing to better suit your needs and only display ads that are relevant to you. You may choose to opt out of any/all internet-based advertising by visiting the Network Advertising Initiative (NAI) website.
Links to Other Sites: MEDISCA may contain links to other websites which are not operated by MEDISCA, such as social network sites and interactive maps that provide directions to our locations. If you visit one of these sites, please be advised that we are not responsible for any policies and practices of the other companies. Changes and Updates to the Privacy Statement: MEDISCA’s Privacy Statement is subject to change without notice. MEDISCA takes all steps necessary to data protection laws in order to protect your information. The Terms and Conditions of this Agreement constitute a legal agreement between the Visitor, Subscriber and/or Registrant and MEDISCA. Some Terms and Conditions, clearly specified in this Agreement, are only applicable to the Subscriber and Registrant. MEDISCA encourages the Visitor, Subscriber and/or Registrant to take the time to become familiar with this Agreement. The Terms and Conditions of this Agreement, in whole or in part, are intended to protect the Visitor, Subscriber and/or Registrant from any unauthorized or illicit act. If any Visitor, Subscriber and/or Registrant should have any questions or concerns about this Agreement or its Content, please contact MEDISCA via email.
This site may contain material from third parties, including advertising and promotion, as well as informational and educational material. Such material may be paid or unpaid, placed by MEDISCA or by a third party, incorporated in the site or in separate spaces thereon reserved for such material. Subscriber and Registrant Rights and Responsibilities: The Subscriber has all the responsibilities of the Registrant, even if they do not have the right of access, or right of use, of restricted access screens on this Website. The Subscriber has the responsibility to ensure the designated and registered Registrant is in full knowledge of, and in full agreement with, the Terms and Conditions of this Agreement. The Subscriber reserves the right to terminate the username and password of a Registrant by contacting MEDISCA. A new username and password may be issued to a new designated Registrant. If a Subscriber and/or Registrant should have any questions or concerns about this aspect of the Agreement or its Content, please contact MEDISCA.
Registrant: Must be a licensed pharmacist or other appropriately state licensed professional.
If Subscriber is the Registrant: Has the right of purchase of MEDISCA products and/or services, and as a licensed pharmacist or other appropriately state licensed professional who wishes to participate in, or use, MEDISCA products and/or services on their own behalf, has the right of use of restricted access screens on this Website, and the right of use of username and password to access these restricted screens, unless otherwise specified.
If Subscriber IS NOT the Registrant: Has the right of purchase of MEDISCA products and/or services. If not a licensed pharmacist or other appropriately state licensed professional and serves only as the payer for MEDISCA Network products and/or services on behalf of a Registrant, then the Subscriber does not have the right of use of restricted access screens on this Website, nor the right of use of username and password to access these restricted screens, unless otherwise specified.
Registrant, Username and Password Protection and Security: This Website contains screens that are limited to a Registrant only, and access restricted through the use of a username and password for reasons of safety and security. The Registrant that has been granted access to these username and password screens are restricted from any unauthorized use, release or divulgence of username and password, and any and all Content contained within these restricted screens, for any reason and under any conditions.
Limitation of Use of Username and Password and Content: Any breach with regard to unauthorized use, release or divulgence of username and password and/or this Website Content, on the part of the Registrant, will result in immediate severability of that Account and will be subject to prosecution under the law.
No Resale of MEDISCA Products and/or Services: The Subscriber or Registrant may not resell any product and/or service to any other person or business entity. The Subscriber or Registrant may not assign a beneficiary, in the form of another person or business entity, to any product and/or service, without the expressed written consent of MEDISCA.
Termination of Access to MEDISCA Products and/or Services: MEDISCA reserves the right to terminate an account, shut down this website, or restrict access to all or part of this website to any or all persons, for any reason, at its sole discretion. If such action was not caused by the breach by the Subscriber or Registrant of the terms of this Agreement, or any other fault of them, then MEDISCA will refund any unused portion of fees paid by the Subscriber.
Use of Name “MEDISCA”: MEDISCA encourages the development of professional relationships with recognized institutions and other business entities, and as such establishes authorized unilateral or bilateral links to their websites. However, MEDISCA reserves the right to restrict the use of its name or any unauthorized links to this Website, in any form or for any purpose, without the express written consent of MEDISCA.
